The provider of the Wexelcode app and the services offered through it ("App") is Wexelcode GmbH, Maisacher Str. 118, 82256 Fürstenfeldbruck ("Wexelcode," "we," or "us").
These Terms of Use apply to the use of the App and all directly or indirectly related services provided by Wexelcode through the internet, mobile applications, and email.
By installing and using the software, the user confirms that they have read, understood, and accepted these Terms of Use as binding.
Wexelcode provides users with a solution through the Wexelcode App and its associated services for a digital screening process to prepare for potential physiotherapy treatment. The App allows patients (e.g., before their first visit to a physiotherapy practice) to complete a questionnaire as part of the screening process. The responses are evaluated against specific criteria to determine whether physiotherapy treatment might be appropriate or whether a doctor should be consulted as a precaution.
This evaluation is only a preliminary indication and does not replace a professional anamnesis or diagnosis by your physiotherapist or doctor. In particular, the App is not intended for diagnosing, preventing, monitoring, predicting, treating, alleviating, or compensating for diseases, injuries, or disabilities, nor for investigating or altering anatomy or any physiological or pathological process or condition.
Users can save the questionnaire results as a PDF or share them directly with a selected professional (e.g., a physiotherapy practice) available within the App
A user account (registration) is required to complete the screening process, in which entered data is temporarily stored for a limited period.
(1) Permitted Use and User Obligations
(2) Users may use the App and the services offered through it exclusively for their intended purposes (see "Nature and Scope of the App"). Any other use of the App is prohibited without prior written consent from Wexelcode.
(3) Users may access content in the App only via its designated functionality through its user interface. Extracting program code and/or content (e.g., reverse engineering) is prohibited.
(4) Users may not use, modify, distribute, or reproduce content or technical elements of the App (e.g., software code) for commercial purposes.
(5) Users may not engage in actions intended to disrupt or impair the functionality of the App, its services, or systems used for its provision (especiallyWexelcode’s systems).
(6) Wexelcode reserves the right to block access to the App and its services if these Terms of Use are violated, without prejudice to asserting other rights.
User Responsibilities:
(7) Users must provide accurate information to the best of their knowledge within the App and its services.
(8) Users must not enter personal data of others into the App or its services.
(9) Users must keep their App login credentials confidential and not share them with third parties.
(10) Users must not transmit or provide unlawful content (e.g., offensive, defamatory, racist, pornographic, terrorist content, or content that violates third-party rights) via the App or its services.
(11)Users confirm that they are at least 16 years old.
Wexelcode charges a fixed fee of [amount] for its services. All fees are displayed in [currency] and are non-refundable unless explicitly stated otherwise.
Payments must be made via the approved payment methods listed on our platform, including [list of accepted payment methods, e.g., credit/debit cards, PayPal, etc.].
By submitting your payment information, you authorize Wexel Code to charge the applicable fees using the payment method you provide. All payment information must be accurate, current, and complete.
If payment is not completed by the due date, Wexel Code reserves the right to suspend access to the service until the outstanding balance is paid in full.
Users are responsible for any applicable taxes, duties, or additional charges related to the purchase of services. Wexel Code is not liable for any bank fees, exchange rate differences, or other charges incurred by the user.
Wexel Code reserves the right to modify its fees at any time. Any changes to fees will be communicated to users at least [timeframe, e.g., 30 days] in advance, and will only apply to new transactions after the effective date.
Using the App and its services may require providing personal data, which will be processed locally within the App and on Wexelcode’s systems. For more information on how your data is handled, refer to the privacy policy. This policy is provided for informational purposes and is not part of these Terms of Use.
Wexelcode reserves the right to restrict or suspend the App and its services at its discretion (e.g., for maintenance, capacity, or security reasons). Wexelcode does not guarantee uninterrupted availability and acknowledges that temporary unavailability due to technical issues is possible.
(1) Wexelcode provides no guarantees regarding the functionality, suitability, availability, or reliability of the App or its services.
(2) Liability is excluded unless it is mandatory (e.g., due to intent, gross negligence, injury to life, body, or health, assumption of a guarantee, fraudulent concealment of a defect, or violation of essential contractual obligations).
Essential contractual obligations are those that enable the proper execution of the contract and upon which the contracting parties regularly rely. Liability for the breach of such obligations is limited to foreseeable, typical damages unless caused by intent or gross negligence.
(3) Users agree to indemnify Wexelcode for damages resulting from their violation of these Terms of Use or applicable laws.
(1) Intellectual property rights belong to Wexelcode or its licensors.
(2) Wexelcode reserves the right to modify or remove existing App functions or services and to add new ones.
(3) Users may terminate their use of the App at any time.
(4) Wexelcode may amend these Terms of Use at its discretion, provided it is reasonable for the user.
(5) Users will be informed of changes in advance. If users do not object within four weeks, the amended Terms will be deemed accepted.
(6) German law applies. The place of jurisdiction is Wexelcode’s registered office.
